Should you hire an employee or a contractor (consultant)?
Treating a real employee as a "consultant" to save costs can backfire. Answer six questions about the role to get a clear recommendation.
Hire as an employee (or fixed-term employee)
The role looks like employment; a consultant label could be challenged.
- Monthly pay
- ₹50,000
Why
- You control how and when they work — a hallmark of employment.
- Working only for you points to employment.
- Ongoing work suggests an employee (or fixed-term employee).
- Core business work is usually done by employees.
Next steps
- See the true monthly cost including PF and gratuity.
- Issue an offer letter.
- Register for PF/ESI when you cross the thresholds.
Classification depends on all facts and labour-law rules in your state. Not legal advice — confirm with a CA or lawyer.
Common questions
Why does the difference matter?
Employees get PF, ESI (where applicable), gratuity, leave and labour-law protection, and salary TDS. Contractors invoice you and you deduct TDS on contract or professional payments. If a "contractor" is really an employee, authorities can demand back dues with interest.
Can I hire on a fixed-term contract?
Yes. The labour codes recognise fixed-term employment with the same benefits as permanent staff, including pro-rata gratuity after one year.
