The twelve tables at the back, how the Constitution changes, and what can never change
The appendix of the Constitution
Articles say what should happen; Schedules hold the long lists, like the appendix of a textbook. The Seventh Schedule matters most: the Union List (defence, railways, foreign affairs), the State List (police, public health, agriculture) and the Concurrent List (education, forests, marriage). If a Union law and a State law on a Concurrent subject clash, the Union law generally prevails.
- Education and forests moved to the Concurrent List in 1976
Summary
Schedules are the tables at the back of the Constitution. There are twelve; eight were there in 1950. The First lists the States and Union Territories, the Third holds the forms of oaths, the Fourth allots Rajya Sabha seats, the Fifth and Sixth deal with Scheduled and tribal areas (the Sixth only in Assam, Meghalaya, Tripura and Mizoram), the Seventh divides law-making power into the Union, State and Concurrent Lists, and the Eighth lists the 22 recognised languages. Four were added later: the Ninth (1951, land reform laws), the Tenth (1985, anti-defection), the Eleventh (1992, panchayats, 29 subjects) and the Twelfth (1992, municipalities, 18 subjects).
Article 368 gives Parliament the power to amend the Constitution. An amendment bill can start in either House and must be passed in each House by a special majority: a majority of the total membership and two-thirds of the members present and voting. Amendments that affect the federal structure, such as the distribution of powers or representation of States in Parliament, also need ratification by at least half of the State legislatures. There is no joint sitting for an amendment bill, and the President must give assent.
Parliament’s power to amend has a limit. In the Kesavananda Bharati case (1973) the Supreme Court held that Parliament can amend any part of the Constitution but cannot destroy its basic structure, which includes features such as the supremacy of the Constitution, democracy, secularism, federalism, separation of powers and judicial review. Landmark amendments to remember: the 42nd (1976, the "mini-Constitution"), the 44th (1978, property removed from Fundamental Rights), the 61st (1989, voting age 18), the 73rd and 74th (1992, local government), the 86th (2002, Article 21A) and the 101st (2016, GST).
