How environment laws of india works
Think of the laws as tools added one at a time as new problems appeared. The oldest still in use is the Indian Forest Act, 1927, which lets governments declare reserved, protected and village forests. After independence, the Wild Life (Protection) Act, 1972 gave legal protection to listed animals and plants and created sanctuaries and national parks.
Then came pollution. The Water Act, 1974 set up the Central and State Pollution Control Boards to control water pollution, and the Air Act, 1981 gave the same boards the job of controlling air pollution. In between, the Forest (Conservation) Act, 1980 said that forest land cannot be used for non-forest purposes, such as mines or dams, without Central Government approval. In 2023 it was renamed the Van (Sanrakshan Evam Samvardhan) Adhiniyam.
The Bhopal gas tragedy of December 1984 showed that the older laws were not enough. Parliament passed the Environment (Protection) Act, 1986, an umbrella law that gives the Centre wide powers to protect the environment as a whole and to set standards. The Public Liability Insurance Act, 1991 followed, to give quick relief to victims of accidents with hazardous substances.
Newer laws deal with people and money. The Biological Diversity Act, 2002 regulates access to biological resources through the National Biodiversity Authority. The Forest Rights Act, 2006 recognises the rights of forest-dwelling communities. The National Green Tribunal Act, 2010 created a special court for environmental cases, and the Compensatory Afforestation Fund Act, 2016 manages money paid to grow new forests when forest land is diverted.
