Constitutional, Statutory and Executive Bodies
Ask one question of every body: where does its power come from?
Three kinds of birth certificate
Every public body has a kind of birth certificate. If it is born in the Constitution, it is constitutional. If it is born in an Act of Parliament, it is statutory. If it is born in a government resolution, it is executive. The stronger the birth certificate, the harder it is to change the body.
Summary
A constitutional body is created by the Constitution itself, in its own article, so changing or abolishing it needs a constitutional amendment. Examples: the Election Commission (Article 324), which conducts elections to Parliament, State Legislatures and the offices of President and Vice-President; the Union Public Service Commission (Article 315); the Finance Commission (Article 280), set up by the President every five years to recommend how taxes are shared between the Union and the States; and the Comptroller and Auditor-General (Article 148), who audits government accounts.
A statutory body is created by an ordinary Act of Parliament, which another Act can change. Examples: the National Human Rights Commission (Protection of Human Rights Act, 1993), the National Commission for Women (1990 Act), the Central Information Commission (Right to Information Act, 2005), the National Green Tribunal (2010) and the Lokpal (Lokpal and Lokayuktas Act, 2013). An executive body is set up by a government resolution, with no special law behind it: NITI Aayog was created by a Union Cabinet resolution in 2015 to replace the Planning Commission, which had itself been set up by a resolution in 1950.
Some bodies change type, and these are exam favourites. The National Commission for Backward Classes was statutory until the 102nd Amendment (2018) made it constitutional under Article 338B. The Central Vigilance Commission began in 1964 by a government resolution and became statutory through the CVC Act, 2003. The CBI was set up by a Home Ministry resolution in 1963 and draws its powers from the Delhi Special Police Establishment Act, 1946. The National Commissions for Scheduled Castes (338) and Scheduled Tribes (338A) are constitutional.
