Fundamental Rights Remedies: The Five Writsमौलिक अधिकारों के उपचार: पाँच रिटमूलभूत हक्कांचे उपाय: पाच रिट questions and answersप्रश्न और उत्तर
A right is only as strong as the way to enforce it. Writs are the court orders that make Fundamental Rights real. There are five, each with a Latin name, and each fixes a different kind of wrong.

How fundamental rights remedies: the five writs works
Habeas corpus means "you may have the body". If someone is locked up, the court can order that the person be brought before it and released if the detention is illegal. It protects personal liberty, and it can be used even against a private person holding someone.
Mandamus means "we command". If a government office refuses to do what the law requires, such as issuing a certificate you are entitled to, the court can order it to do its duty. It cannot be used against the President, Governors or private individuals.
Prohibition and certiorari both keep lower courts and tribunals within their limits. Prohibition is issued while a case is still going on, to stop it. Certiorari is issued after an order is passed, to cancel it. A simple way to remember: prohibition prevents, certiorari corrects.
Quo warranto means "by what authority". If someone holds a public office without the right qualifications, the court can ask them to prove their right to it, and remove them if they cannot. Any person, not just the one affected, can ask for it.

Common mistakes
- Thinking only the Supreme Court can issue writs. High Courts can too, under Article 226, and for more than just Fundamental Rights.
- Swapping prohibition and certiorari. Prohibition stops a case; certiorari cancels a finished order.
- Thinking mandamus lies against a private person. It lies only against public bodies and officials.
