Summary

Fundamental Rights are in Part III, Articles 12 to 35. Learn them in blocks: equality 14 to 18, freedom 19 to 22, against exploitation 23 and 24, freedom of religion 25 to 28, cultural and educational rights 29 and 30, and the right to constitutional remedies in Article 32. Article 12 defines "the State" against which these rights can be claimed, and Article 13 makes any law that takes them away void. The right to property was removed from this list by the 44th Amendment (1978) and is now a legal right under Article 300A.

Some rights belong only to citizens, such as Articles 15, 16, 19, 29 and 30, while others, such as equality before law (14) and protection of life and personal liberty (21), protect every person in India, including foreigners. Article 21A, added by the 86th Amendment in 2002, gives every child aged 6 to 14 the right to free and compulsory education. Even during a national emergency, the rights in Articles 20 and 21 cannot be suspended.

The Directive Principles of State Policy (Part IV, Articles 36 to 51) are goals for governments, such as village panchayats (40), a uniform civil code (44), protecting the environment (48A) and separating the judiciary from the executive (50). Article 37 says courts cannot enforce them, yet they are fundamental in governing the country. The Fundamental Duties in Article 51A (Part IVA) were added by the 42nd Amendment in 1976; there were ten, and the 86th Amendment added an eleventh, making parents and guardians responsible for giving their children aged 6 to 14 a chance to study.
