Three organs, two levels
Think of a school: one group makes the rules (legislature), another runs the school every day (executive) and a third settles disputes over the rules (judiciary). India has this at the Union level (Parliament, President with the Council of Ministers, Supreme Court) and in each State (Legislature, Governor with the Council of Ministers, High Court).
- President 52 · Parliament 79 · Supreme Court 124
- Governor 153 · High Court 214
Summary
Government in India has three organs, the legislature, the executive and the judiciary, at two levels, the Union and the States. At the Union level the President (Article 52) is the head of the State, but acts on the aid and advice of the Council of Ministers headed by the Prime Minister (Article 74). The President is elected by the elected members of both Houses of Parliament and of the Legislative Assemblies of the States, Delhi and Puducherry, and can be removed only by impeachment (Article 61). In each State, the Governor (Article 153) plays a similar role and is appointed by the President.
Parliament (Article 79) is the President, the Rajya Sabha and the Lok Sabha. A money bill (Article 110) can be introduced only in the Lok Sabha; the Rajya Sabha can only suggest changes within 14 days, and the Speaker decides whether a bill is a money bill. When the Houses disagree on an ordinary bill, the President can call a joint sitting (Article 108), but never for a money bill or a constitutional amendment. When Parliament is not in session, the President can issue an ordinance (Article 123), which lapses six weeks after Parliament reassembles unless approved; Governors have the same power under Article 213.
The Supreme Court (Article 124) is the highest court and the guardian of the Constitution; its judges retire at 65 and can be removed only by Parliament for proved misbehaviour or incapacity. Each State has a High Court (Article 214), whose judges retire at 62. The Constitution has three emergency provisions: a national emergency under Article 352 (war, external aggression or armed rebellion), President’s rule in a State under Article 356 (when the State government cannot be carried on as the Constitution requires), and a financial emergency under Article 360, which has never been declared.
