Two doors to the courts

If the State takes away your Fundamental Right, Article 32 is a door straight into the Supreme Court. Article 226 is a door into your State’s High Court, and it is a wider door: it opens for Fundamental Rights and for other legal rights too.

  • Article 32 is itself a Fundamental Right

Summary

A right is only as strong as the way to enforce it. Article 32 lets any person whose Fundamental Right has been violated go straight to the Supreme Court, and it is itself a Fundamental Right; Dr Ambedkar called it the heart and soul of the Constitution. Article 226 gives every High Court the power to issue writs too, and this power is wider: a High Court can issue writs for Fundamental Rights and also "for any other purpose", that is, to enforce ordinary legal rights.

There are five writs. Habeas corpus ("you may have the body") orders that a detained person be produced before the court, to test whether the detention is lawful; it can be issued even against a private person. Mandamus ("we command") orders a public official or body to perform a duty it has failed to do; it does not lie against private persons, the President or a Governor. Quo warranto ("by what authority") asks a person holding a public office to show their right to it.

Prohibition and certiorari keep lower courts and tribunals within their powers. Prohibition is issued while a case is still pending, to stop it from going beyond its jurisdiction; certiorari is issued after an order is passed, to quash it. A simple memory line: prohibition prevents, certiorari corrects. Since the 1980s the courts have also accepted public interest litigation, where a person or group can approach the court on behalf of people who cannot do so themselves.
